Embraved is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, attend our workshops or events, or otherwise communicate with us. •     Business and organizational information including your business or organization name, job title, and professional contact details, for example when you request a quote or place a corporate, nonprofit, or “Recognition Gifts” order.

•     Event and workshop information including registration and attendance details when you sign up for or attend a workshop or event.

•     Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.

•     Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

•     Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to produce custom-engraved and personalized items, to fulfill and ship gifts to the recipients you designate, to administer subscriptions, to register you for workshops and events, to remember your preferences and items you are interested in, to send notifications related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases.

•     Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.

•     Security and Fraud Prevention. How We Disclose Personal Information

•     With Shopify, and with vendors and other third parties who perform services on our behalf, such as payment processing, order fulfillment and shipping, custom production and personalization, email and text-message marketing (for example, Klaviyo), scheduling and consultations (for example, Calendly), workshop and event registration (for example, Eventbrite), in-person point-of-sale and payment processing at markets and pop-ups (for example, Square), website hosting, data analytics (for example, Google Analytics), customer support, and cloud storage.

•     With business and marketing partners to provide marketing services and advertise to you, including advertising platforms such as Meta (Facebook and Instagram) and Google. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. •     With shipping carriers and the recipients of gifts you purchase, to deliver your order to the recipient and address you designate.

•     When you direct, request us, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.

•     With our affiliates or otherwise within our corporate group.

•     In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. Gifts, Personalization, and Information About Other People

Because we sell gifts and personalized products, we often collect and process personal information about people other than the person placing the order.

Gift recipients. When you purchase a gift, send a pre-curated gift box, or use multi-address checkout to send orders to more than one person, you may provide us with the recipient’s name, shipping address, and a personal note or message to be included with the gift. We use this information only to produce, package, and deliver the gift you have ordered and to communicate with you about that order. If you provide us with another person’s personal information, you represent that you have the authority to do so and to allow us to use it for these purposes. Recognition Gifts and bulk orders for organizations. When a business, nonprofit, foundation, firm, or other organization places a bulk or “Recognition Gifts” order, the organization may provide us with the names, addresses, and other details of the individuals who will receive the gifts (for example, donors, employees, clients, or partners). In these cases we process that recipient information on the organization’s behalf and at its direction, solely to fulfill and deliver the order. The organization is responsible for ensuring it has the right to share that information with us and for responding to any privacy requests its recipients may have, and we will support the organization in responding to such requests as required by applicable law.

Personalization and customer artwork. When you submit artwork, logos, monograms, images, or text to be engraved, printed, or otherwise added to a product, we use that content solely to produce and fulfill your order. We do not claim ownership of your content. You are responsible for ensuring that you have the legal right to use and submit any artwork, logos, trademarks, or other materials you provide, as further described in our Terms of Service. We retain personalization files only as long as needed to fulfill your order, support reorders, and meet our legal and business-record obligations.

In-Person and Offline Interactions

In addition to our website, we collect personal information when you interact with us in person — for example, when you make a purchase or place a walk-in personalization order at a farmers market, pop-up location, workshop, or event. At these locations, payments are typically processed through a third-party point-of-sale provider (for example, Square), and we may collect your name, contact details, and order or payment information in the same way we would online. If you provide your email address or phone number in person, we will use it consistent with this Privacy Policy, including for marketing only where permitted by law and where you have not opted out.

Cookies and Tracking Technologies

We and our service providers use cookies, pixels, web beacons, and similar technologies to operate and secure the Services, remember your preferences and the items in your cart, analyze site traffic and performance, and support marketing and personalized advertising. This includes analytics and advertising technologies such as Google Analytics and the Meta (Facebook) pixel. Marketing Communications

We may send you promotional communications by email, text message (where you have provided your number and consented as required by law), or postal mail. In accordance with the CAN-SPAM Act and other applicable laws, our marketing emails identify themselves as advertising where required, include our business mailing address, and provide a way to unsubscribe. You can opt out of promotional emails at any time by using the unsubscribe link in any such email or by contacting us using the details below. If you opt out of promotional messages, we may still send you non-promotional messages, such as those about your orders, subscriptions, or account. If you are located in the European Union, we will add you to our marketing email list only if you affirmatively consent to receiving such messages.

We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Children’s Data

The Services are not intended for or directed to children, and we do not knowingly collect personal information from children. Consistent with the U.S. Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13, and children under 13 should not use the Services or provide us with any personal information. Consistent with the Virginia Consumer Data Protection Act, we do not process the personal data of a known child (under 13) for purposes of targeted advertising, the sale of personal data, or profiling. As of the effective date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) the personal information of individuals under 16 years of age. Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, and payment card information is encrypted in transit and handled by our third-party payment processors rather than stored on our own servers.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with the Services, to fulfill and support orders and reorders, to comply with legal, tax, and accounting obligations, and to resolve disputes or enforce other applicable contracts and policies.
